On Monday, November 18, Gautam Gambhir, the Indian head coach, who is currently in Australia, got a big relief in a cheating case from the Delhi High Court. In a case wherein home buyers were allegedly cheated involving Gautam Gambhir, the session’s court had earlier passed an order to set aside a trial court order of discharging him and others from the cheating case, but after the 43-year-old challenged the decision of the session’s court, the Delhi High Court stayed the order against him.
Notably, as per the report from the Bar and Bench, the cheating case was involving three companies, namely Rudra Buildwell Realty, HR Infracity, and UM Architectures and Contractors, which had promoted and advertised a housing project called “Serra Bella” in 2011. Gautam Gambhir was a brand ambassador for the project apart from being the additional director of the Rudra Buildwell Realty, but when the project didn’t quite come to surface for a long time, the homebuyers filed a cheating case against Gautam Gambhir and the rest after learning about the land for it was entangled in litigation.
Gautam Gambhir was discharged from cheating case by trial court before session's court overturned their decision
In 2020, the trial court had a prima facie case against just three people and two companies for cheating, and they had discharged the rest of the accused, including Gautam Gambhir. After the trial court’s order was challenged by three revision petitions, the session’s court last month was of the opinion that the trial court’s decision to discharge Gautam Gambhir from the case was an “inadequate expression of mind” before deciding to set aside their order apart from directing them to pass a fresh order against the accused.
It led to Gautam Gambhir challenging the session’s court decision in the DelhI High Court, and earlier today, Justice Manoj Kumar Ohri passed the interim order to stay the session’s court order against the accused and said, “'I will pass the order. In the meantime, the impugned order against the petitioner shall remain stayed. I will pass a detailed order.”
Moreover, Gautam Gambhir is currently in Australia with the Indian cricket team as they prepare for the upcoming five-match Border-Gavaskar Trophy (BGT) Test series, beginning on November 22, at the Optus Stadium in Perth.
